Terms & Conditions

These terms govern your use of our website, our showroom and design studio, and every purchase, order, warranty and communication between you and Cherry Hills Kitchens. Please read them carefully. They are written to be plain, precise and unhurried - the same way we field-measure and draw a room before we price it.

The Agreement

General Terms & Acceptance

These Terms & Conditions ("Terms") constitute a binding agreement between you ("you," "your," or "Customer") and Cherry Hills Kitchens ("we," "us," "our," or the "Company"), a design and supply studio for luxury cabinetry and architectural casework based in Cherry Hills, Colorado. By accessing our website, visiting our studio, requesting a field measurement, placing an order, or otherwise engaging our services, you acknowledge that you have read, understood and agreed to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use our website or services. You represent that you are at least eighteen (18) years of age and legally capable of entering into a binding contract in the State of Colorado.

These Terms apply to all channels of engagement, including our website, our showroom and design studio, telephone and email correspondence, and any point-of-sale transaction. Additional policies referenced herein are incorporated by reference and form part of this agreement.

Account Registration & Security

Certain features, such as saving a project, tracking an order, or managing rewards, require you to create an account. You agree to provide accurate, current and complete information and to keep it updated.

Your responsibilities

  • Maintain the confidentiality of your login credentials and any password associated with your account.
  • Accept responsibility for all activity that occurs under your account, whether or not authorized by you.

We reserve the right to suspend or terminate any account that we reasonably believe has provided false information, violated these Terms, or been used for fraudulent or unlawful purposes.

eCommerce & Online Purchases

Pricing

All prices are shown in United States Dollars (USD) and exclude applicable taxes, delivery and installation unless expressly stated. Cabinetry projects are field-measured and drawn before they are priced; any online estimate is indicative until a written quotation is issued. We reserve the right to correct pricing errors even after an order has been submitted.

Payment

We accept major credit cards and other methods displayed at checkout. By submitting payment you represent that you are authorized to use the payment method and that the details are accurate. Custom orders may require a non-refundable deposit before drawings or production begin.

Order confirmation & cancellation

  • An order is not accepted until we issue a written confirmation. A submission acknowledgment is not acceptance.
  • Custom and made-to-order items enter production once approved and generally cannot be cancelled after approval.
  • We may decline or cancel any order due to stock, pricing errors, or suspected fraud, and will refund amounts already charged for cancelled orders.

Shipping & Delivery

Cabinetry is delivered primarily throughout the greater Denver area. Delivery of large casework is coordinated by appointment, and lead times are provided in your written quotation.

Timeframes

Estimated timeframes are provided in good faith and are not guaranteed. Custom cabinetry is built to the room it is going in, and production schedules depend on material availability and site readiness.

Domestic & international

Smaller accessories and hardware may ship via common carrier within the United States. We generally do not ship large casework internationally; where arranged by special agreement, you are responsible for duties, taxes and import compliance.

Risk of loss

Title and risk of loss pass to you upon delivery to the address or site you designate. Please inspect all items on receipt and note any visible damage on the delivery record within forty-eight (48) hours.

Returns, Exchanges & Refunds

Because our cabinetry is custom-made to your drawings, most items are non-returnable. The following applies to eligible goods.

  • Stock accessories & hardware: may be returned within thirty (30) days of delivery, unused and in original packaging.
  • Custom cabinetry & casework: made to order and non-returnable except where defective or non-conforming.
  • Restocking fee: eligible non-custom returns may be subject to a restocking fee of up to twenty-five percent (25%).
  • Refunds: issued to the original payment method within ten (10) business days of our inspection and approval of the returned item.

Deposits for custom work are non-refundable once drawings or production have commenced. To request a return, contact [Contact Email] with your order number.

In-Store / Point of Sale Purchases

Receipts

Please retain your itemized receipt or signed contract. It is required for any warranty claim, exchange or price adjustment. Studio consultations and field measurements are documented in writing and shared with you.

Price matching

Because our cabinetry is custom-drawn to your room, price matching against mass-market or ready-to-assemble products is not offered. Written quotations are honored for the validity period stated on the quotation.

Deposits & scheduled payments

Projects are typically structured as a deposit at approval, a progress payment at production, and a balance at delivery. Scheduled payment terms, where offered, are set out in your written contract.

Product Descriptions & Accuracy

We describe our materials and construction as accurately as possible. Natural materials vary; the following characteristics are inherent and not defects.

  • Wood grain & color: rift-sawn and figured veneers vary in grain, tone and figure between panels and over time.
  • Finish & sheen: hand-applied and lacquered finishes may show slight variation in sheen and texture.
  • Dimensions: nominal dimensions are approximate; field measurement governs final production.
  • Screen color: on-screen representations of color and finish are approximate and may differ from physical samples.

We recommend approving physical samples before production. Small imagery, specifications and drawings are provided for reference and may be updated without notice.

Warranty & Repairs

Limited warranty

We warrant our cabinetry against defects in materials and workmanship under normal residential use for the period stated in your contract, beginning on the date of delivery. This warranty covers repair or replacement, at our discretion, of the defective component.

Exclusions

  • Normal wear, natural aging of wood and finish, and variation described in Section 07.
  • Damage from improper installation by others, misuse, moisture, or failure to follow care instructions.
  • Alterations, repairs, or hardware substitutions made by anyone other than us or our authorized partner.

Repair services & care

We offer repair and refinishing services for our cabinetry. To preserve your finish, dust with a soft dry cloth, wipe spills promptly, avoid abrasive cleaners and excess moisture, and maintain stable interior humidity. To request service, contact [Contact Email].

Customer Loyalty & Rewards Program

If you enroll in our rewards program, points or benefits may be earned on qualifying purchases and redeemed toward eligible goods and services.

  • Earning: points accrue on qualifying purchases as described at enrollment; deposits, taxes and delivery may be excluded.
  • Redemption: rewards have no cash value, are non-transferable, and may not be combined with certain offers.
  • Expiration: points may expire after a period of account inactivity as disclosed in the program terms.
  • Program changes: we may modify, suspend or discontinue the program at any time with reasonable notice.

Gift Cards & Store Credit

  • Purchase: gift cards and store credit are issued in USD and may be used toward eligible products and services.
  • Redemption: redeemable online or in our studio; not redeemable for cash except where required by law.
  • Balance: partial balances remain available for future use until fully redeemed.
  • Expiration: gift cards do not expire except as permitted by applicable Colorado and federal law.

Lost or stolen gift cards may not be replaced without proof of purchase. Store credit is non-transferable.

CRM & Customer Data

We collect and process customer information across our channels, including online forms, studio visits, field measurements, and point-of-sale transactions, in order to serve you.

  • What we collect: contact details, project and site information, order history, and communication preferences.
  • How we use it: to prepare quotations, schedule measurements and delivery, provide warranty service, and, with your consent, share relevant offers.
  • Sharing: we share data with service providers acting on our behalf under confidentiality obligations, and never sell your personal data.

SMS & Email Marketing Communications

By opting in, you consent to receive marketing communications by email and, where separately authorized, by text message (SMS).

  • Opt-in: SMS marketing requires your express prior consent; consent is not a condition of any purchase, consistent with the Telephone Consumer Protection Act (TCPA).
  • Opt-out: reply STOP to any SMS to unsubscribe, or use the unsubscribe link in any email, consistent with the CAN-SPAM Act.
  • Frequency & rates: message frequency varies; message and data rates may apply from your carrier.

We honor opt-out requests promptly. Transactional messages relating to your orders and appointments may still be sent as part of providing our services.

Push Notifications & App Communications

If you enable push notifications through our website or any application, you may receive updates about your project, appointments, and occasional offers. You can manage or disable notifications at any time in your device or browser settings. Disabling notifications does not affect your ability to place orders, but you may miss timely updates about deliveries and appointments.

Intellectual Property

All content on our website and in our materials, including the Cherry Hills Kitchens name, logo, drawings, photographs, designs, text and layout, is owned by or licensed to us and protected by intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without our prior written permission. Design drawings and specifications prepared for your project remain our intellectual property and are provided for the purpose of your project only.

User-Generated Content

When you submit reviews, photographs, comments or other content to us or tag us on social media, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce and display that content in connection with our business.

  • You represent that you own or have the rights to the content you submit.
  • Content must not be unlawful, defamatory, infringing, or otherwise objectionable.
  • We may remove or decline to publish any content at our discretion.

Limitation of Liability & Disclaimers

To the fullest extent permitted by law, our website and services are provided on an "as is" and "as available" basis without warranties of any kind, except for the express limited warranty described in Section 08.

In no event shall Cherry Hills Kitchens be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits or data, arising out of your use of our website, products or services. Our total aggregate liability for any claim shall not exceed the amount you paid for the product or service giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws principles. We prefer to resolve concerns directly and unhurriedly; please contact us first at [Contact Email] so we can work toward a resolution.

If a dispute cannot be resolved informally, you agree that it shall be subject to the exclusive jurisdiction of the state and federal courts located in the County of Arapahoe, Colorado, unless applicable law requires otherwise. Any claim must be brought within one (1) year after it arises, to the extent permitted by law.

Modifications to Terms

We may update these Terms from time to time to reflect changes in our practices, technology or the law. When we do, we will revise the "Last Updated" date above. Material changes will be communicated where appropriate. Your continued use of our website or services after changes take effect constitutes acceptance of the revised Terms.
